Background\nOn April 18, 2026, the United States Court of Appeals for the Second Circuit\ndocketed my emergency motion to stay sentencing under the original mandamus\ncase number 26-361.\n Case: 26-361, 05/23/2026, DktEntry: 29.1, Page 2 of 15\n\n---\n\nOn April 23, 2026, the District Court issued an order adjourning the sentencing to\nJune 29, 2026, stating that: “Due to the complexity of the outstanding issues\nraised in the parties’ voluminous sentencing submissions, see ECF Nos. 826,\n828, 833 …”\nOn May 1, 2026, the Government filed its opposition to the stay, which was\ndocketed under my case number. On the same day, I submitted my response to\nthe Government’s opposition.\nOn May 15, 2026, the Second Circuit issued an order addressing my petition and\nthose of other pro se petitioners proceeding in tandem, denying the petitions\nwithout prejudice to renewal if the district court fails to docket the\nsubmissions within a reasonable time.\nII. Newly Discovered Evidence that Directly Bears on Sentencing\nRecently discovered materials, uncovered independently while reviewing\narchived records, provide corroboration of the factual framework previously set\nforth in both my original mandamus petition and emergency stay motion. These\nmaterials are consistent with the Chinese court document described in Exhibit F\n(pp. 77–88) of my original mandamus, which documented investigative\nquestioning of individuals connected to the financial flows at issue.\nTaken together, the newly identified evidence independently confirms that\ninvestor funds did not move through a direct transfer mechanism, but instead\nfollowed a structured, multi-layered intermediary process. Specifically, funds\noriginating from Chinese investors were first deposited into personal accounts,\nthen routed through foreign-trade company accounts for currency conversion,\nand subsequently transmitted to downstream accounts associated with the\nbroader organizational network described in the record. This routing pattern\nmirrors the intermediary-mediated flow structure previously described in my\nfilings, in which funds were further redistributed through additional designated\naccounts under centralized organizational control.\nImportantly, the newly discovered materials do not merely repeat prior\nassertions, but independently reinforce the existence of a systematic and\nrecurring transaction architecture consistent with the allegations already before\nthe Court. This corroboration strengthens the reliability of my existing record and\n Case: 26-361, 05/23/2026, DktEntry: 29.1, Page 3 of 15\n\n---\n\ndirectly bears on sentencing considerations by further clarifying the manner and\nstructure of the underlying financial flows, including the degree of complexity that\naffects their traceability.\nIn addition, this evidence is consistent with the District Court’s own\ncharacterization of the record as involving “the complexity of the outstanding\nissues raised in the parties’ voluminous sentencing submissions,” and further\ncontextualizes that complexity by illustrating the layered intermediary structure\nunderlying the disputed transactions.\nIII. This shift in the form of recorded\ntransactions further indicates a change in how the investment funds were\nprocessed and documented during the relevant period.\n● Exhibit A further corroborates the remittance structure described in my\noriginal mandamus petition (SDNY 817 at page 8). As reflected in the\nrecords, investors were organized into small groups, each coordinated by\na designated group leader. These investors did not transfer funds directly\nto downstream entities. Instead, each investor transmitted funds to\naccounts designated through the group leader and provided confirmation\n(e.g., screenshots) of the transaction to the group leader.\nSome intermediaries (黄牛) then verified and reconciled these incoming\npayments. Notably, investors did not have direct contact with these\nintermediaries. Following this verification process, funds were routed\nthrough additional accounts, including those associated with foreign-trade\nentities used for currency conversion, before ultimately being transmitted\nto accounts in the United States as designated within the broader network.\nThis structure reflects a layered, intermediary-mediated process in which\nfund flows were segmented across multiple roles and stages, rather than\n Case: 26-361, 05/23/2026, DktEntry: 29.1, Page 5 of 15\n\n---\n\nconducted through direct, traceable investor-to-recipient transfers.\nAt no point in this process did any investors have direct contact with the\nultimate recipients of the funds, and they were not provided with identifying\ninformation regarding those recipients.\nAs set forth in my original mandamus petition (SDNY 817 at page 8), all\nfunds related to Seven Star Farm investments were remitted to accounts\ndesignated by the then Secretary-General of the Alliance, known as\n“Changdao Brother.” These investors did not have direct contact with the\nultimate fund recipients; instead, payments were coordinated through\ndesignated group leaders, who transmitted funds to the specified accounts.\nSubsequently, as reflected in Exhibit A (at page 4), all investment activities\nof Seven Star Farm were abruptly terminated on a specific date, at which\npoint the farm was taken over by an Alliance working group. Following this\nintervention, all ongoing investment arrangements were canceled.\nImportantly, the financial accounts and records associated with these\ntransactions were ultimately consolidated and transferred to Rushui (also\nknown as Hao Yumei), who assumed control over the relevant funds and\naccounting. Rushui (Hao Yumei) maintained control over the financial\naccounts of all farms. All G-series investment records and transaction\ndetails fell within her management and control.\nFor record-preservation purposes, I further note that Exhibit A represents only a\nsmall subset of the broader Seven-Star Farm transaction records, yet it alone\nreflects more than approximately two million dollars in investment-related\ntransfers. Seven-Star Farm was only one of more than ten Himalaya Alliance\nfarms involved in G-Series-related activity, and other farms reportedly\nhandled even larger sums. This raises a series of unresolved questions\nthat bear directly on sentencing reliability: how many Chinese investors in\nfact transmitted funds into the G-Series structure; how many similar farm-\nlevel accounting records, remittance tables, or group-ledger materials\nexist; and how many such investors were later arrested, prosecuted, or\nsentenced in China in connection with the same underlying investment\nactivity, thereby creating further cross-sovereign conflict concerning the\nlegal characterization of those funds. Based on the structure reflected in\n Case: 26-361, 05/23/2026, DktEntry: 29.1, Page 6 of 15\n\n---\n\nthe present record, it appears that key transaction details, investor\nidentities, and farm-level accounting materials were maintained or\ncontrolled by Hao Yumei (also known as Rushui), the former Alliance\nSecretary-General Xia Qidong, the court identified as the co-conspirator in\nSDNY Dkt. 382, 388, also known as “Changdao Brother,” and the current\nSecretary-General, a Government registered victim, known as “Qingteng.” I\ndo not ask the Court to resolve those broader factual questions on this\nsubmission alone. I preserve the narrower but important point that the currently\nvisible record may reflect only a fraction of the underlying investor population,\ntransaction data, and cross-sovereign complications, and that sentencing should\nnot proceed on the assumption that the existing victim-and-loss picture is\ncomplete.\nIV. Serious Procedural Impact on Sentencing\nThe newly identified materials reflected in Exhibit A raise serious procedural\nconcerns bearing directly on the reliability of any sentencing determination,\nparticularly with respect to victim composition, loss calculations, and the factual\nintegrity of the record on which sentencing is expected to proceed.\n\n1. Exhibit A corroborates that the Government’s visible victim presentation\nreflects only a limited subset of the affected investor population, and that the\nnonappearance of Chinese investors does not mean they do not exist.\nThe structure reflected in Exhibit A is consistent with the concern raised by\nChunk Chyi in Second Circuit No. 26-77, Dkt. 18: namely, that the victim\npopulation visible in the criminal proceedings appears to represent only a partial\nsubset of the broader investor body. As reflected in various recent § 853(n)-\nrelated mandamus proceedings and district-court filings, including SDNY Dkts.\n838, 844, and 845, increasing numbers of Chinese investors have surfaced only\nthrough third-party and appellate processes rather than through the\nGovernment’s own presentation of victim interests. Exhibit A independently\nreinforces that point. It demonstrates that the absence of Chinese investors from\n Case: 26-361, 05/23/2026, DktEntry: 29.1, Page 7 of 15\n\n---\n\nthe visible trial record does not mean they were nonexistent, uninvolved, or\nunaffected. Rather, the record suggests that a substantial portion of the investor\npopulation—particularly mainland Chinese investors—was simply not\nmeaningfully reflected in the Government’s courtroom presentation. To the extent\nthe sentencing framework relies on an assumed victim picture that does not\nadequately account for this broader population, that framework may be materially\nincomplete.\n2. Exhibit A reveals severe fund-mixing and intermediary-layering problems that\ndirectly undermine the reliability of loss calculations.\nExhibit A does not reflect a simple one-investor-to-one-recipient transfer model.\nInstead, it reflects a segmented and intermediary-mediated architecture involving\ngroup leaders, verification by intermediaries, foreign-trade company accounts,\ncurrency conversion, and subsequent routing through further designated\naccounts. This structure raises serious questions regarding whether the\nGovernment’s asserted loss model has been adequately tested against the\nactual underlying fund flows. In particular, it raises the possibility of mismatch\nbetween nominal transferors and true beneficial investors, fragmentation of what\nmay be a single economic loss across multiple visible names or transactions, and\nthe risk that the same underlying funds may be represented or counted in more\nthan one way. In a sentencing context, these features are highly significant. A\nloss model that relies on simplified inflow figures without adequately accounting\nfor the intermediary structure reflected in Exhibit A may be materially distorted.\n3. The newly identified materials also reinforce the cross-sovereign\ncontamination problem previously preserved in my original mandamus petition.\nAs described in my original mandamus petition, the Guo-related investment\ncases in China were treated as matters subject to “centralized handling.” That\n Case: 26-361, 05/23/2026, DktEntry: 29.1, Page 8 of 15\n\n---\n\ncontext strongly suggests that the arrest, prosecution, coercion, and punishment\nof investors connected to the same investment flows were not isolated or\nexceptional occurrences, but part of a broader and recurring pattern. Indeed, as\npreviously preserved, some investors connected to the same transactions have\nreportedly been arrested, prosecuted, and sentenced in China; it has even been\nreported that at least some such individuals suffered catastrophic consequences\nwhile in detention. Whether or not each such report can be individually\nresolved in this proceeding, the narrower point is clear: a substantial\nportion of the funds at issue may have originated from persons whose\nparticipation in the same investments was already criminalized by Chinese\nauthorities before those funds were fully translated into the Government’s\nAmerican victim-and-loss framework. In that sense, the source population\nitself was legally and politically burdened before the funds even reached the\nUnited States. That reality further destabilizes any simplified sentencing\nassumption that the relevant funds can be cleanly mapped onto a uniform,\nuncomplicated victim class.\n\n4. When Exhibit A is read together with my prior record-preservation submission\nin Second Circuit No. 26-361, Dkt. 22, and the Government’s own filing in SDNY\nDkt. 716-4, it raises a serious question whether the Government knowingly\nproceeded on a materially simplified financial narrative.\n\nAs preserved in my response to the Government in Second Circuit No. 26-361,\nDkt. 22, at page 3, the Government’s own filing in SDNY Dkt. 716-4 indicates that\nfederal investigators had already examined aspects of the Chinese-investor\nstructure as early as 2022. Yet at trial, the Government’s presentation, including\nthe testimony of FBI Special Agent Kimberly Espinoza (SDNY Dkt. 425 at p. 129)\nand expert Paul Hinton (SDNY Dkt. 441), appears to have rested on a\n Case: 26-361, 05/23/2026, DktEntry: 29.1, Page 9 of 15\n\n---\n\nsignificantly simplified “money-in/money-out” fraud model. Exhibit A now\nprovides concrete documentary support that the relevant fund flows were\nmaterially more layered, intermediary-driven, and identity-distorting than\nsuch a simplified model would suggest. If the Government possessed\nsubstantially greater knowledge of the actual upstream Chinese-investor\nstructure, yet presented only a flattened endpoint version of those\ntransactions, that raises a serious record-integrity concern. At minimum, it\nsuggests that the Court should not proceed to sentencing without first\ndetermining whether the current victim and loss framework rests on a sufficiently\ncomplete and reliable account of the underlying financial flows.\nIn sum, Exhibit A materially strengthens the concerns already preserved in\nmy prior filings. It suggests that the current sentencing record may rest on\na victim framework that reflects only a partial subset of the true investor\npopulation, and on a loss model that has not been adequately tested\nagainst the actual intermediary structure of the underlying transactions.\nUnder these circumstances, careful scrutiny of the reliability of the\nsentencing record is warranted.\nV. Preservation of Objections to Proceeding to Sentencing\nWithout Resolution of the Above Issues\nIn SDNY Dkt. 837, this Court adjourned sentencing to June 29, 2026, expressly\nstating that the adjournment was warranted “[d]ue to the complexity of the\noutstanding issues raised in the parties’ voluminous sentencing submissions.” In\naddition, the Second Circuit, in its May 15, 2026 order, denied certain mandamus\nrelief without prejudice to renewal if the district court fails to docket the\n Case: 26-361, 05/23/2026, DktEntry: 29.1, Page 10 of 15\n\n---\n\nsubmissions within a reasonable time.\nThe present submission is made in part to assist the Court in its ongoing\nhandling of these issues and, if necessary, to clarify the basis for any\nrenewed mandamus relief sought before June 29, 2026. In light of the Court’s\nown acknowledgment of unresolved complexity, and in light of the Second\nCircuit’s express recognition that continued non-docketing may warrant renewal,\nI respectfully preserve my objection to any sentencing proceeding that moves\nforward before the above-described issues are meaningfully addressed.\nMore specifically, I preserve my objection to proceeding to sentencing on a\nrecord that remains materially burdened by unresolved disputes\nconcerning victim composition, loss calculations, intermediary fund-\nrouting, cross-sovereign investor status, and the reliability of submissions\nor frameworks derived from potentially compromised sources. To the\nextent those issues remain unresolved, sentencing on the present record\nwould risk reliance on a materially incomplete or unreliable factual\nfoundation.\nRespectfully submitted.\nTony\nMay 所反映的并非单一投资者对单一接收方的简单转账模式。相反，它反映了一种涉及组长、中间人核实、外贸公司账户、货币转换以及随后通过进一步指定账户进行转账路由的分段式且由中间人协调的架构。该结构对政府所主张的损失模型是否已对照实际底层资金流进行充分检验提出了严重质疑。具体而言，它引发了名义转账人与真实受益投资者之间不匹配的可能性、可能属于单一经济损失的款项在多个可见姓名或交易中被割裂拆分的可能性，以及相同底层资金可能被以不止一种方式重复呈现或计算的风险。在量刑背景下，这些特征具有高度重要性。一个依赖于简化的资金流入数字，而未充分考虑附件 A 所反映的中间人结构的损失模型，可能会产生实质性的扭曲。\n\n3. 新近确认的材料还强化了先前在我原调卷令申请书中所保留的跨主权污染问题。\n\n正如我原调卷令申请书中所述，中国境内涉郭投资案件被作为“集中办理”的事项对待。该背景有力地表明，对与相同投资资金流相关的投资者进行的抓捕、起诉、胁迫和惩罚并非孤立或例外的个案，而是更广泛且反复出现的模式的一部分。事实上，正如先前所保留的记录，据报道，与相同交易相关的某些投资者已在中国被抓捕、起诉和判刑；甚至有报道称，至少部分此类人员在羁押期间遭遇了灾难性后果。无论每项此类报道能否在本次诉讼程序中逐一予以解决，狭义上的论点是明确的：涉案资金中相当大的一部分可能来源于这样一些人员——在中国当局将其资金完全转化为政府的美国受害者及损失框架之前，他们参与相同投资的行为就已经被中国当局定为犯罪。从这个意义上说，这些资金甚至在抵达美国之前，资金来源群体本身就已经承受了法律和政治上的重负。这一现实进一步动摇了任何关于相关资金可以清晰对应于单一、无复杂情况的受害者群体的简化量刑假设。\n\n4. 将附件 A 与我此前在第二巡回法院案号 No. 26-361、Dkt. 22 中提交的记录保留陈述，以及政府自身在 SDNY Dkt. 716-4 中的提交文件结合阅读时，引发了关于政府是否在明知的情况下依据实质上被简化的财务叙事进行推进的严重疑问。\n\n正如我在第二巡回法院案号 No. 26-361、Dkt. 22 第 3 页对政府的回应中所保留的内容，政府自身在 SDNY Dkt. 716-4 中的提交文件表明，联邦调查人员早在 2022 年就已调查了中国投资者结构的各方面。然而在审判中，政府的陈述（包括联邦调查局特别探员 Kimberly Espinoza 的证词（SDNY Dkt. 425 第 129 页）以及专家 Paul Hinton 的证词（SDNY Dkt. 441））似乎建立在一个显著简化的“资金流入/资金流出”欺诈模型之上。附件 A 目前提供了具体的书证支持，证明相关的资金流比此类简化模型所显示的具有更多层级、更受中间人驱动且更具身份失真性。如果政府对实际的上游中国投资者结构掌握着多得多的了解，却仅仅呈现了那些交易的扁平化终点版本，这便引发了对记录完整性的严重关切。至少，这表明法院在未首先确定当前的受害者和损失框架是否建立在对底层资金流足够完整和可靠的说明之上以前，不应径行进入量刑。\n\n总而言之，附件 A 实质性地强化了我此前提交文件中已保留的关切。它表明，当前的量刑记录可能建立在一个仅反映真实投资者群体局部子集的受害者框架之上，以及建立在一个未对照底层交易的实际中间人结构进行充分检验的损失模型之上。在此等情况下，对量刑记录的可靠性进行审慎审查是正当且必要的。\n\nV. 保留在未解决上述问题前推进量刑的异议\n\n在 SDNY Dkt. 837 中，本院将量刑推迟至 2026 年 6 月 29 日，并明确指出推迟是合理的，“[鉴]于双方当事人大量的量刑提交材料中所提出的未决问题的复杂性”。此外，第二巡回法院在其 2026 年 5 月 15 日的命令中，驳回了特定的调卷令救济，但不损害在地区法院未能在合理时间内将提交材料录入案卷的情况下重新提出的权利。\n\n提出本份陈述，部分是为了协助法院持续处理这些问题，并在必要时阐明在 2026 年 6 月 29
