Interpretation**\n\nIn this Part, unless the context otherwise requires—\n\n- *civil proceedings* (民事法律程序), in relation to the requesting court, means proceedings in any civil or commercial matter;\n- *live television link* (電視直播聯繫) means a system in which two places are equipped with, and linked by, audio visual facilities that enable persons at one place to see and hear persons at the other place, and vice versa, at the same time; *(Added 23 of 2003 s. 12)*\n- *requesting court* (提出請求的法院) has the meaning given in section 75;\n- *request* (請求、請求書) includes any commission, order or other process issued by or on behalf of the requesting court.\n\n*[cf. 1975 c. 34 s. 9(1) U.K.]*\n\n#### **Evidence for civil proceedings**\n\n#### **75. Application to the Court of First Instance for assistance in obtaining evidence for civil proceedings in another court**\n\nWhere an application is made to the Court of First Instance for an order for evidence to be obtained in Hong Kong and the court is satisfied—\n\n(a) that the application is made in pursuance of a request issued by or on behalf of a court or tribunal (*the*  3\n\nEvidence Ordinance\n\nPart VIII 8-4 Section 76 Cap. 8\n\n> *requesting court*) exercising jurisdiction in a country or territory outside Hong Kong; and\n\n(b) that the evidence to which the application relates is to be obtained for the purposes of civil proceedings which either have been instituted before the requesting court or whose institution before that court is contemplated,\n\nthe Court of First Instance shall have the powers conferred on it by this Part.\n\n> *(Amended 25 of 1998 s. 2) [cf. 1975 c. 34 s. 1 U.K.]*\n\n### **76. Power of a court in Hong Kong to give effect to an application for assistance**\n\n- (1) Subject to this section, the Court of First Instance shall have power, on any such application as is mentioned in section 75, by order to make such provision for obtaining evidence in Hong Kong as may appear to the court to be appropriate for the purpose of giving effect to the request in pursuance of which the application is made; and any such order may require a person specified therein to take such steps as the court considers appropriate for that purpose. *(Amended 25 of 1998 s. 2)*\n- (2) Without prejudice to the generality of subsection (1) but subject to this section, an order under this section may, in particular, make provision—\n\t- (a) for the examination of witnesses by any means, including by way of a live television link; *(Amended 23 of 2003 s. 13)*\n\t- (b) for the production of documents;\n\t- (c) for the inspection, photographing, preservation, custody or detention of any property;\n\nEvidence Ordinance\n\nPart VIII 8-6\n\nSection 77 Cap. 8\n\n3\n\n(e) for the medical examination of any person.\n\n- preclude the making of an order requiring a person to give evidence otherwise than on oath where this is asked for by the requesting court. *(Amended 23 of 2003 s. 13)*\n- (4) An order under this section shall not require a person—\n\t- (a) to state what documents relevant to the proceedings to which the application for the order relates are or have been in his possession, custody or power; or\n\n(d) for the taking of samples of any property and the\n\nsteps to be taken unless they are steps which can be required to be taken by way of obtaining evidence for the purposes of civil proceedings in the court making the order (whether or not proceedings of the same description as those to which the application for the order relates); but this subsection shall not\n\n(3) An order under this section shall not require any particular\n\ncarrying out of any experiments on or with any property;\n\n- (b) to produce any documents other than particular documents specified in the order as being documents appearing to the court making the order to be, or to be likely to be, in his possession, custody or power.\n- (5) A person who, by virtue of an order under this section, is required to attend at any place shall be entitled to the like conduct money and payment for expenses and loss of time as on attendance as a witness in civil proceedings before the Court of First Instance. *(Amended 25 of 1998 s. 2)*\n\n*[cf. 1975 c. 34 s. 2 U.K.]*\n\n### **77. Privilege of witnesses**\n\n(1) A person shall not be compelled by virtue of an order under section 76 to give any evidence which he could not be compelled to give—","body_zh":"《证据条例》（Evidence Ordinance）\n\n第VIII部 8-2 第74条 第8章\n第VIII部\n在其他司法管辖区的法律程序中使用的证据\n\n（第VIII部由1977年第2号第3条取代）（格式变更——2018年编正版第4号）\n74. 释义\n\n在本部中，除文意另有所指外——\n\n- 民事法律程序（civil proceedings），就提出请求的法院而言，指任何民事或商业事宜中的法律程序；\n- 电视直播联系（live television link），指由两处地方设置视听设施并借该等设施相连的系统，使一处地方的人能够同时看见及听见另一处地方的人，反之亦然；（由2003年第23号第12条增补）\n- 提出请求的法院（requesting court），具有第75条所给予的涵义；\n- 请求（request、请求书），包括由提出请求的法院发出或代表该法院发出的任何委托书、命令或其他法律程序文件。\n\n［参见 1975 c. 34 s. 9(1) U.K.］\n民事法律程序所用的证据\n75. 向原讼法庭（Court of First Instance）申请协助获取用于另一法院民事法律程序的证据\n\n凡有人向原讼法庭申请命令，要求在香港获取证据，而该法庭信纳——\n\n(a) 该申请是依据在香港以外的国家或地区的法院或审裁处（提出请求的法院）发出或代表其发出的请求而提出的；且\n\n《证据条例》\n\n第VIII部 8-4 第76条 第8章\n\n提出请求的法院）行使管辖权；且\n\n(b) 与该申请有关的证据，是为已向提出请求的法院提起或正考虑向该法院提起的民事法律程序之目的而拟获取的，\n\n则原讼法庭享有本部赋予它的权力。\n\n（由1998年第25号第2条修订）［参见 1975 c. 34 s. 1 U.K.］\n76. 香港法院使协助申请生效的权力\n\n- (1) 在符合本条的规定下，原讼法庭在收到第75条所述的任何此类申请时，有权借命令就香港获取证据作出该法庭认为适宜的规定，以使提出该申请所依据的请求生效；且任何此类命令均可要求其中指定的任何人采取法庭认为适宜用于该目的的步骤。（由1998年第25号第2条修订）\n- (2) 在不损害第(1)款的一般性但符合本条规定的原则下，本条项下的命令尤其可就以下各项作出规定——\n\t- (a) 以任何方式讯问证人，包括借电视直播联系的方式讯问；（由2003年第23号第13条修订）\n\t- (b) 出示文件；\n\t- (c) 检验、拍摄、保存、保管或扣留任何财产；\n\n《证据条例》\n\n第VIII部 8-6\n\n第77条 第8章\n(e) 对任何人进行身体检查。\n\n- 阻止作出要求某人在提出请求的法院提出要求时以未经宣誓方式作证的命令。（由2003年第23号第13条修订）\n- (4) 本条项下的命令不得要求任何人——\n\t- (a) 说明与其申请该命令所涉法律程序相关的哪些文件现正或曾经由其管有、保管或掌管；或\n\n(d) 获取任何财产的样本，以及\n\n采取任何特定步骤，除非该等步骤是作出该命令的法院在为民事法律程序目的获取证据时可以要求采取的步骤（不论是否与申请该命令所涉法律程序性质相同的程序）；但本款并不\n\n(3) 本条项下的命令不得要求\n\n对任何财产进行或使用任何财产进行任何试验；\n\n- (b) 出示除该命令中指明的特定文件以外的任何文件，而该等文件在作出命令的法院看来是属于或相当可能属于由其管有、保管或掌管的文件。\n- (5) 凭借本条项下的命令被要求出席任何地点的人，有权享有如同作为证人出席原讼法庭民事法律程序时相同的出庭旅费以及开支与误工补偿。（由1998年第25号第2条修订）\n\n［参见 1975 c. 34 s. 2 U.K.］\n77. 证人的特权\n\n(1) 任何人不得凭借第76条项下的命令而被强迫提供其在以下情况下不能被强迫提供的任何证据——","key_entities":["Je"],"ecf_references":[],"word_count":798,"status":"published","published_at":null,"created_at":null,"updated_at":"2026-08-23 12:29:18"}
