BONGARTZ:
If it doesn't, please let -- okay. |\n| 14 | This is Alex Bongartz, of Paul Hastings, for the |\n| 15 | Chapter 11 Trustee. |\n| 16 | As Your Honor noted, we have two matters going |\n| 17 | forward at today's hearing.
I don't have a particular |\n| 18 | preference, but I will start in the order they were filed. |\n| 19 | The first one being the motion related to certain agreements |\n| 20 | and other operational issues concerning the Lady May II. |\n| 21 | Just to briefly recap, much of the focus to date |\n| 22 | has been on the Lady May.
Obviously, Your Honor will recall |\n| 23 | that you had approved a motion authorizing the Trustee to |\n| 24 | enter into a yacht management agreement with Yachtzoo as |\n| 25 | well as a crew provision agreement.
You had also authorized |\n| | |\n\nCase 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 6 of 20\n\nHo Wan Kwok - May 10, 2023 6 the Trustee to retain Edmiston as sales broker. And you would also recall you had authorized relocating the Lady May to the navigable waters of Rhode Island, in particular the shipyard in Newport. Today, I'll be turning now to the Lady May II. And I think the easiest way to present this motion is to look at the four aspects of the motion on which -- in which we're seeking relief. The first one is very straightforward. We simply seek to add the Lady May II to the agreement that had already been approved with respect to the Lady May, in particular, the management agreement with Yachtzoo and the crew provision agreement with FDS. And the addenda had been attached to the motion. And as I stated, they simply add the Lady May II to those agreements. And I should also note that with respect to the yacht management agreement Yachtzoo will not charge any additional monthly fees. As it relates to the crew provision agreement, by virtue of the fact that there will be a new captain for the Lady May II, the number of crew members, the total number of crew members across both yachts will actually increase from five to six, which results in a small increase of a monthly fees of around \\$900 to around \\$1200. And that actually brings me to the second aspect\n\nCase 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 7 of 20\n\n| | Ho Wan Kwok - May 10, 2023
7 |\n|----|----------------------------------------------------------------|\n| 1 | of the relief we're seeking in this motion, and that is the |\n| 2 | employment of the captain for the Lady May II.
I want to be |\n| 3  | very precise.
The Trustee is not himself engaging or hiring |\n| 4 | the captain.
The captain would be hired by FDS through the |\n| 5 | crew provision agreement which I just covered. |\n| 6 | But we still want the Court to be aware that there |\n| 7 | is a captain that is being selected and hired here and we |\n| 8 | want authorization for the Trustee to direct FDS to then go |\n| 9 | out and hire the captain. |\n| 10 | In particular, we have selected Mr. William Burke, |\n| 11 | who has substantial maritime experience as we have described |\n| 12 | in the motion. |\n| 13 | And of particular note he would only be hired on a |\n| 14 | part-time basis.
I think the -- well, we detailed in the |\n| 15 | motion that the daily fee would be \\$300 and we're expecting |\n| 16 | him to be on the boat and working there for around two to |\n| 17 | three days per week. |\n| 18 | That now brings me to the third aspect and that is |\n| 19 | the Lady May II is currently dry docked in Mamaroneck. |\n| 20 | She's currently sitting under a plastic wrap. |\n| 21 | And in order to be able to sell her we need to |\n| 22 | commission her, which essentially just means putting her |\n| 23 | back into the condition that she can be returned into the |\n| 24 | water. |\n| 25 | There is seasonal maintenance that will need to be |\n| | |\n\nCase 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 8 of 20\n\nHo Wan Kwok - May 10, 2023 8 done in connection with that, but all in we believe that this work absolutely has to be done in order for the Lady May to be returned into the water and ultimately to be marketed for sale. We had attached a work order with the Safe Harbor facility in Mamaroneck. That's the location where the Lady May II is currently located. And that work order has a cost estimate for the commissioning of the Lady May of approximately \\$10,300. And that brings me to the fourth aspect, and that is the funding of these expenses and other operation and maintenance expenses with respect to the Lady May II. We're requesting that as with the Lady May the Trustee be authorized to use again up to \\$500,000 that the Court had previously authorized out of the repair reserve to fund the operation and maintenance of the Lady May and now by extension also of the Lady May II. I should note that there has been no objection to any aspect of the relief and we would ask that Your Honor grant the relief requested. Thank you. THE COURT: Thank you. Does anyone else wish to be heard with regard to the motion for order authorizing the operation of the Lady May II? BONGARTZ:
Your Honor, yes, of course. |\n| 19 | The second motion concerns the Lady May.
And we |\n| 20 | had previewed the relief sought in this motion on several |\n| 21 | occasions before and now we are finally ready to formally |\n| 22 | request the Court authorize the Lady May to be transferred |\n| 23 | into the Foreign-Trade Zone at the Newport shipyard. |\n| 24 | I want to reiterate a point that I had made at the |\n| 25 | prior hearing.
This does not involve a physical movement of |\n| | |\n\nHo Wan Kwok - May 10, 2023 10 the Lady May. It is stated a legal designation and we've confirmed with the shipyard that the Lady May will stay even at the same dock. Now, the benefit of the Foreign-Trade Zone is the ability to avoid the payment of excise taxes. The Foreign- Trade Zone exempts U.S. residents from having to buy -- for having to pay custom taxes in connection with the purchase. And, in fact, unless we were -- unless the estate were to pay custom duties to import the Lady May into the United States, we couldn't even market the yacht to U.S. residents. To be also very clear, as we laid out in our motion, the cost of such duties would be approximately \\$400,000. That is not an insignificant cost. And it's substantial if you compare to the incremental costs and fees that would be incurred with transferring the Lady May into the FTZ. Specifically, we've been informed by the Safe Harbor shipyard in Newport that there would be an incremental monthly fee of approximately \\$11,000 to dock the Lady May within the, again, legal designation, of the FTZ. There is also an indemnity bond that is required under FTZ regulations. We've been informed and we've also attached a copy of the invoice for that indemnity bond. That the bond will cost approximately \\$5,900 and change. Case 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 10 of 20\n\nCase 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 11 of 20\n\nHo Wan Kwok - May 10, 2023 11 And we've also attached the application in unsigned form to our motion. Our intention is that as soon as the Court grants, or assuming the Court grants the motion, the Trustee will sign and then submit the application to the surety. The final point I want to note in our motion is that as with the prior operating expenses for the Lady May, as well as the operating expenses for the Lady May II, we're requesting that the incremental fees, as well as the cost of the indemnity bond be funded out of the previously approved \\$500,000 from the repair reserve. I note that there were no objections. There was one reservation of rights filed by HK USA, but they did not take a position on the motion and we don't view that as in any way an objection to the relief sought. Thank you, Your Honor. That was all from my end. THE COURT: Thank you. I just have a question with regard to both motions that I should have asked with regard to the prior motion. Assuming this motion is also granted, how much money will be left in the \\$500,000 account out of the repair reserve if these costs are paid? MR. BONGARTZ: We have drawn down approximately 300 to 350,000 out of the repair -- out of the \\$500,000 set aside to date. The large majority of that amount was\n\nCase 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 12 of 20\n\nHo Wan Kwok - May 10, 2023 12 actually for insurance premiums that had to be paid for the Lady May. So there should be approximately 150, 180,000 or so left. And that's -- I don't have the precise math, but that's just approximately. THE COURT: Okay. Thank you. Does anyone else wish to be heard on the motion for order authorizing transfer of the Lady May to the Foreign-Trade Zone? (No response) THE COURT: Okay. Hearing nothing, then I have reviewed the motion. I understand the reason why the -- the reasons why the Chapter 11 Trustee is moving for this order authorizing the transfer of the Lady May to the Foreign-Trade Zone, which appears to obviously benefit the estate because there will be less costs associated with possible sale of the Lady May if the Lady May is in the Foreign-Trade Zone. No one has filed any -- and there are other benefits as well, but that is one of the obvious benefits. I understand that the Trustee has to also apply for and obtain an indemnity bond, and that all related fees, including the fee for the bond and the incremental dockage fees -- which are not substantial, Attorney Bongartz, correct? I think you just stated that on the record that the dockage fees are not substantial.\n\nCase 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 13 of 20\n\nHo Wan Kwok - May 10, 2023 13 MR. BONGARTZ: The incremental dockage fees are 11,000 per month. THE COURT: Right. MR. BONGARTZ: As noted. THE COURT: And that no one has filed any written objection to this motion. There's no one participating in this hearing that is objecting to this motion. And for all those reasons, the motion is granted and the proposed order that was submitted with the motion can enter. MR. BONGARTZ: Thank you, Your Honor. THE COURT: Okay. MR. BONGARTZ: I would like to just add one more point. It has nothing to do with the relief sought, but I wanted Your Honor to be aware. As we had mentioned previously, the repair of the sea valve is currently being postponed. It's not being done at this time. And if and when it were to go forward we obviously will need additional resources beyond the 500,000. But we would obviously come back to Your Honor in that event and hopefully there would also by then be other resources available in the estate. But as of right now there is only a de minimis amount of cash in the estate, so we'll have to come back.\n\nHo Wan Kwok - May 10, 2023 14 THE COURT: Okay. Thank you. Case 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 14 of 20\n\n All right. With regard to these two motions today then, we have resolved those motions. They've been granted, the proposed orders have entered.\n\n I have an issue that I wanted to talk to the parties about.\n\n And I thought someone from the debtor might be here today. So they're not. So you'll have to, Trustee Despins, and Attorney Bongartz, Attorney Linsey, report to the debtor about an issue which is not controversial. It's just something.\n\n I got and I received notification that in adversary 22-5032, which is the preliminary injunction social media doxxing adversary proceeding that PAX commenced in which we had the four-day trial in December that the designation of the record has been transferred to the district court.\n\n And the issue that appears to be -- needs to be adjusted and corrected from the Court's perspective is that the designated items on both parties' designation of record of items for the record on appeal do not include the corrected transcripts of the hearings that were held the first three days in December. So I think that's the 5th, 6th and 7th, although I could be wrong about those exact dates. But, in any event, there are three transcripts that Case 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 15 of 20\n\n| | Ho Wan Kwok - May 10, 2023
15 |\n|----|----------------------------------------------------------------|\n| 1 | were filed after the fact by the reporter which included |\n| 2 | corrections that were listed in errata sheets. |\n| 3 | So the transcripts that are not part of the |\n| 4 | designation of the record on appeal in adversary 22-5032 are |\n| 5 | ECF Nos. 192, 193 and 194. |\n| 6 | And the reason that the Court wants the parties to |\n| 7 | include those transcripts in the designation of the record |\n| 8 | is because if the district court uses the original |\n| 9 | transcripts, 104, 105, 106, which were redacted, they don't |\n| 10 | match up with the errata sheets. |\n| 11 | And it would be confusing to the district court I |\n| 12 | think to be trying to match up those transcripts, 104, 105 |\n| 13 | and 106, with the errata sheets because the lines don't |\n| 14 | match up. |\n| 15 | Originally what the reporter did in 104, 105 and |\n| 16 | 106 when information or exhibits or testimony was redacted |\n| 17 | they just said redacted.
They didn't account for lines in |\n| 18 | the transcripts or pages in the transcripts. |\n| 19 | But the transcripts 192, 193 and 194 are -- do |\n| 20 | match up insofar as they include the corrected information |\n| 21 | in the errata sheets.
Okay? |\n| 22 | So someone needs to alert the district court to |\n| 23 | that because I think there could be a lot of confusion.
And |\n| 24 | that doesn't make a lot of sense to me.                        |\n| 25 | Now, it's true that the preliminary injunction                 |\n|    |                                                                |\n\nCase 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 16 of 20\n\nHo Wan Kwok - May 10, 2023 16 decision issued by the Court in January relied on 104, 105 and 106 because 192, 193 and 194 weren't available yet. And I know the debtor isn't here. But I think something needs to be filed in the district court indicating that 192, 193 and 194 should be part of the designation of the record and there should be some explanation as to why, because otherwise I think it could be very confusing. MR. LINSEY: Well, Your Honor, I apologize. I believe, Your Honor, there's a mechanism under Rule 8009 to supplement and correct the record, so we can speak with counsel for the debtor about that. That's at Docket 1766. We filed that last Friday. And we want to make sure that it is on Your Honor's radar screen. And the other -- it's really in the nature of a question, Your Honor, and I'm kind of reluctant to ask it, but on the work plan planning issue, I'm sure Your Honor knows that our work plan is dependent on funding. I noticed that, and we don't have to address this right at the moment, but I think just it may be I thought there were two matters scheduled for hearing on April -- I'm sorry, May 23rd. And I only see one at the moment and it's an application to employ. But I thought there were two. I don't know. But if for some reason the matters on the 23rd you want to continue them to the 30th when there are other matters already scheduled, that's fine. You know, figure that out. And if you want to do that, file a motion. Or if you just want to go through with whatever's on on the 23rd, we can do that too. I just point that out. I'm just looking at things that are already scheduled for hearing. MR. DESPINS: Understood, Your Honor. THE COURT: Okay. MR. DESPINS: We may very well do that. THE COURT: Okay. All right. 签订游艇管理协议以及船员提供协议。您还准许受托人聘用 Edmiston 作为销售经纪人。您还会记得，您已准许将 Lady May 迁移至罗得岛州的可航行水域，特别是纽波特的船厂。\n\n案件 22-50073 文件 1800 提交日期 05/17/23 登记日期 05/17/23 16:35:41 第 6 页，共 20 页\n\nHo Wan Kwok（郭文贵）— 2023年5月10日\n\n现在，我将转而谈及 Lady May II。我认为呈述本动议最简便的方式，是审视我们请求救济的动议四个方面。\n\n第一点非常直接。我们仅请求将 Lady May II 加入已获批准的有关 Lady May 的协议，特别是与 Yachtzoo 的管理协议及与 FDS 的船员提供协议。协议附录已附于动议。如我所述，其仅是将 Lady May II 加入这些协议。\n\n我还应指出，就游艇管理协议而言，Yachtzoo 不会收取任何额外的月费。就船员提供协议而言，由于 Lady May II 将配备一名新船长，两艘游艇的船员总人数实际上将从五人增加至六人，因此月费将小幅增加，从约 \\$900 增至约 \\$1200。\n\n这实际上引出了我们在本动议中请求救济的第二个方面，即聘用 Lady May II 的船长。我想非常准确地说明。受托人本人并不聘用或雇用该船长。该船长将由 FDS 根据我刚刚谈及的船员提供协议聘用。\n\n但我们仍希望法院知悉，这里正在选定并雇用一名船长，并希望获得准许，由受托人指示 FDS 随后聘用该船长。\n\n具体而言，我们已选定 William Burke先生，其拥有大量航海经验，正如我们在动议中所述。\n\n特别值得注意的是，他仅以兼职方式受聘。我认为——嗯，我们已在动议中详述，其日费为 \\$300，我们预计他每周将在船上工作约两至三天。\n\n这现在引出了第三个方面，即 Lady May II 目前停泊在 Mamaroneck 的干船坞内。她目前被塑料罩覆盖。\n\n为了能够出售她，我们需要使其重新投入使用，这实质上仅意味着将其恢复至可重新下水的状态。\n\n需要为此进行季节性维护，但总体而言，我们认为，为使 Lady May 能够重新下水并最终推向市场出售，这些工作绝对必须完成。\n\n案件 22-50073 文件 1800 提交日期 05/17/23 登记日期 05/17/23 16:35:41 第 8 页，共 20 页\n\nHo Wan Kwok（郭文贵）— 2023年5月10日\n\n我们已附上与位于 Mamaroneck 的 Safe Harbor 设施签订的工作订单。该地点是 Lady May II 目前所在之处。该工作订单估算，为使 Lady May 重新投入使用所需费用约为 \\$10,300。\n\n这引出了第四个方面，即为 Lady May II 的这些费用以及其他运营和维护费用提供资金。\n\n我们请求，如同 Lady May 一样，准许受托人再次使用法院此前已准许从维修准备金中拨付的最多 \\$500,000，以资助 Lady May 的运营和维护，并进一步资助 Lady May II 的运营和维护。\n\n我应指出，对于所请求救济的任何方面均无人提出异议，我们请求法官阁下准予所请求的救济。谢谢。\n\n法官：谢谢。还有其他人希望就准许运营 Lady May II 的命令之动议发表意见吗？\n\n（无人回应）\n\n案件 22-50073 文件 1800 提交日期 05/17/23 登记日期 05/17/23 16:35:41 第 9 页，共 20 页\n\nHo Wan Kwok（郭文贵）— 2023年5月10日\n\n法官：好的。既然没有听到任何回应，那么我——\n\nBongartz律师，我正在查看您拟定的命令。\n\nBONGARTZ先生：是。\n\n法官：其中确实准许受托人指示 FDS 聘用 Burke先生担任船长。它确实完全实现了您就该动议所作陈述中概述的事项。\n\n我同意，没有任何人对您的动议提出书面异议，今天参加本次听证会的任何人也没有反对该动议。\n\n基于所有这些理由，准许运营 Lady May II 的命令之动议获准，您提交的拟定命令可以登记。\n\nBONGARTZ先生：非常感谢，法官阁下。\n\n法官：谢谢。现在您想转入下一项动议吗？\n\nBONGARTZ先生：法官阁下，是的，当然。\n\n第二项动议涉及 Lady May。我们此前已数次预先说明该动议所请求的救济，现在我们终于准备正式请求法院准许将 Lady May 转移至纽波特船厂的对外贸易区。\n\n我想重申我在先前听证会上所提出的一点。这不涉及 Lady May 的实际移动。\n\nHo Wan Kwok（郭文贵）— 2023年5月10日\n\n这是法律上的指定，我们已向船厂确认，Lady May 甚至将继续停泊在同一泊位。\n\n现在，对外贸易区的好处在于能够避免缴纳消费税。对外贸易区使美国居民免于在购买时缴纳关税。事实上，除非我们——除非财产管理人支付关税将 Lady May 进口至美国，否则我们甚至无法向美国居民推销该游艇。\n\n同样为清楚起见，正如我们在动议中所述，该等关税的费用约为 \\$400,000。这不是一笔无关紧要的费用。若与将 Lady May 转入 FTZ 所产生的增量成本和费用相比，该费用数额巨大。\n\n具体而言，纽波特的 Safe Harbor 船厂已告知我们，在 FTZ 这一同样属于法律上指定的区域内停泊 Lady May，每月将产生约 \\$11,000 的增量费用。\n\nFTZ 规章还要求提供赔偿保证金。我们已获告知，且我们也已附上该赔偿保证金发票的副本。该保证金费用约为 \\$5,900 零头。\n\n案件 22-50073 文件 11\n\n而且，我们还将未签署形式的申请书附在了我们的动议中。我们的意图是，一旦法院准许，或者假定法院准许该动议，受托人将签署该申请书，然后将其提交给担保公司。关于我们的动议，我想指出的最后一点是，如同此前“Lady May”号的运营费用以及“Lady May II”号的运营费用一样，我们请求从先前批准的维修准备金中 $500,000 支付增量费用以及补偿保证金的费用。我注意到，没有人提出异议。HK USA（HK USA）提交了一份权利保留声明，但其未就该动议表明立场，我们不认为这以任何方式构成对所请求救济的异议。谢谢，法官阁下。我这边就这些。\n\n法庭：谢谢。关于这两项动议，我有一个问题；这个问题我本应就先前的动议提出。假定本动议也获准，如果支付这些费用，维修准备金中 $500,000 账户还将剩余多少钱？\n\nBONGARTZ先生：迄今为止，我们已从预留的 $500,000 中支取了大约 300 至 350,000。该金额的绝大部分实际上用于支付“Lady May”号必须支付的保险费。因此，应该还剩大约 150, 180,000 左右。这个——我没有精确计算，但这只是大致数额。\n\nCase 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 12 of 20\n\nHo Wan Kwok（郭文贵）- May 10, 2023 12\n\n法庭：好的。谢谢。还有其他人希望就授权将“Lady May”号转移至对外贸易区（Foreign-Trade Zone）的命令动议发表意见吗？\n\n（无人回应）\n\n法庭：好的。既然无人发言，我已审阅该动议。我理解第11章受托人申请作出该项授权将“Lady May”号转移至对外贸易区的命令的理由，这显然似乎有利于破产财产，因为如果“Lady May”号位于对外贸易区，其可能出售所涉的费用将更少。没有人提交任何——此外还有其他益处，但这是其中一项显而易见的益处。我理解受托人还必须申请并取得补偿保证金，而且所有相关费用，包括该保证金的费用以及增量停泊费——该停泊费数额并不大，Bongartz 律师，正确吗？我认为您刚才已在记录中说明，停泊费数额并不大。\n\nCase 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 13 of 20\n\nHo Wan Kwok（郭文贵）- May 10, 2023 13\n\nBONGARTZ先生：增量停泊费为每月 11,000。\n\n法庭：是的。\n\nBONGARTZ先生：如所述。\n\n法庭：并且，没有人就本动议提交书面异议。没有参加本次听证的任何人反对本动议。基于所有这些理由，该动议获准，并可录入随动议提交的拟议命令。\n\nBONGARTZ先生：谢谢，法官阁下。\n\n法庭：好的。\n\nBONGARTZ先生：我想再补充一点。这与所请求的救济无关，但我希望法官阁下知悉。正如我们此前提到的，海水阀的维修目前正在推迟。目前尚未进行维修。如果以及当该维修继续进行时，我们显然将需要超出 500,000 的额外资源。但在那种情况下，我们显然会再向法官阁下提出，而且届时希望破产财产中也会有其他可用资源。但截至目前，破产财产中只有极少量现金，因此我们必须再回来。\n\nHo Wan Kwok（郭文贵）- May 10, 2023 14\n\n法庭：好的。谢谢。\n\nCase 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 14 of 20\n\n好的。那么，关于今天这两项动议，我们已经处理完这些动议。它们已获准，拟议命令已录入。\n\n我有一个问题想与各方讨论。\n\n我原以为债务人一方今天会有人到场。但他们没有到场。因此，Despins 受托人和 Bongartz 律师、Linsey 律师，你们必须向债务人报告一个并无争议的问题。这只是某件事情。\n\n我收到并接到通知，在对抗程序 22-5032 中，即 PAX（PAX）提起的关于初步禁令、社交媒体人肉曝光的对抗程序——我们曾于12月就该程序进行了为期四天的审理——案卷指定材料已移送地区法院。\n\n从本庭的角度看，似乎需要调整和纠正的问题是，双方当事人对上诉案卷材料的案卷指定中，均未包括12月前三天举行的听证会的更正后庭审记录。因此，我认为是 5th、6th 和 7th，尽管这些确切日期我可能记错了。但无论如何，有三份庭审记录——\n\nCase 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 15 of 20\n\nHo Wan Kwok（郭文贵）- May 10, 2023\n\n1　由记录员事后提交，其中包括在勘误表中列出的更正。\n\n2　因此，在对抗程序 22-5032 的上诉案卷指定中未列入的庭审记录为 ECF Nos. 192, 193 and 194。\n\n3　法院希望各方将这些庭审记录纳入案卷指定的原因是，如果地区法院使用原始庭审记录 104、105、106——这些记录经删节——它们将无法与勘误表对应。\n\n4　我认为，地区法院若试图将这些庭审记录 104、105 和 106 与勘误表对应，将会感到困惑，因为其行号无法对应。\n\n5　记录员最初在 104、105 和 106 中处理信息、证物或证言被删节的情况时，只写了“已删节”。他们没有对庭审记录中的行数或页数作出处理。\n\n6　但是，庭审记录 192、193 和 194——确实能够对应，因为它们包含勘误表中的更正信息。好吗？\n\n7　因此，需要有人就此提醒地区法院，因为我认为可能会造成很多混乱。这对我来说没有多大意义。\n\n8　诚然，法院于1月作出的初步禁令判决书援引了 104、105 和 106，因为当时 192、193 和 194 尚不可用。因此，Despins 受托人，我——嗯，实际上，我想我应该与 Sarnoff 先生谈。我是说，他是——他曾是原告。他代表作为原告的 PAX。我知道债务人不在场。但我认为应当向地区法院提交某份文件，说明 192、193 和 194 应成为案卷指定的一部分，并应就原因作出一些解释，因为否则我认为这可能会非常令人困惑。\n\nMR. LINSEY：法官阁下，我很抱歉。我相信，根据 Rule 8009，有一项补充和更正案卷的机制，因此我们可以就此与债务人的律师沟通。\n\n法庭：是的。是的。不，我明白。\n\nMR. LINSEY：是。\n\n法庭：但我的意思是，你们需要去做，必须有人去做。\n\nMR. LINSEY：是。\n\n法庭：这才是重点。好吗？\n\nMR. LINSEY：是。\n\n法庭：因为否则——\n\nCase 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 17 of 20\n\nHo Wan Kwok（郭文贵）- May 10, 2023\n\n1　MR. LINSEY：谢谢您提出此事。\n\n2　法庭：——我认为这将会非常——这可能会令地区法院非常困惑。而在四天的审理中，其中三天的庭审记录无法与勘误表对应，我认为，您知道，某人会很头疼，而我们显然不希望发生这种情况。好吗？\n\n3　不过，Sarnoff 先生？\n\n4　MR. SARNOFF：嗯哼。是的。谢谢您，法官阁下。\n\n5　您让我们注意到一件我认为我们要么遗漏了、要么并不知悉的事情，我们可以——我们可以与债务人的律师和受托人的律师沟通，确保案卷得到补充、更正，并且（听不清）。\n\n6　法庭：很好。我感谢这一点。我认为地区法院也会感谢这一点。好吗？\n\n7　MR. SARNOFF：我们会尽力而为，如人们所说。\n\n8　法庭：谢谢。\n\n9　好的。Despins 受托人，今天下午还有其他需要处理的事项吗？\n\n10　MR. DESPINS：没有，法官阁下。只有两项更新，重大更新。\n\n11　首先，我们希望确保法官阁下知道，我们已就债务人儿子在 Genever Holdings（Genever Holdings）案件中提出的一项债权异议提交了违约通知。该通知载于 Docket 1766。我们于上周五提交了该通知。我们希望确保法官阁下已注意到此事。另一件事——实际上属于一个问题，法官阁下，我有些不愿提出，但关于工作计划规划问题，我相信法官阁下知道，我们的工作计划取决于资金。出于规划目的，如能了解法院预计何时就简易判决罪名项 2 作出裁决，将对我们有所帮助，因此，您知道，我提出这个问题，法官阁下。\n\n12　法庭：我理解你的问题，而且我将——我们将——我会尽快作出裁决。我们已经审阅——我正在——当我这样说时，我是否正在处理？是的。\n\n13　MR. DESPINS：这就是我说我犹豫是否提出这个问题的原因。我的团队迫使我提出。我很抱歉。谢谢您，法官阁下。\n\n14　法庭：谢谢。还有其他——\n\n15　MR. DESPINS：我就这些。\n\n16　法庭：——我们今天下午需要处理的事项吗？\n\n17　MR. DESPINS：从我们的角度，没有。谢谢。\n\nCase 22-50073 Doc 1800 Filed 05/17/23 Entered 05/17/23 16:35:41 Page 19 of 20\n\nHo Wan Kwok（郭文贵）- May 10, 2023 19\n\n法庭：好的。我注意到，而且我们现在不必处理此事，但我想，也许是，我原以为有两项事项排定于 April——抱歉，May 23rd 举行听证。但我此刻只看到一项，即聘用申请。但我以为有两项。我不清楚。不过，如果出于某种原因，你们希望将 23rd 的事项延期至 30th，而届时已有其他事项排定，那没问题。你们知道，自行处理。如果想这样做，就提交动议。或者，如果你们只是想按 23rd 所安排的事项继续进行，我们也可以这样做。我只是指出这一点。我只是在查看已排定举行听证的事项。\n\nMR. DESPINS：明白，法官阁下。\n\n法庭：好的。\n\nMR. DESPINS：我们很可能会这样做。\n\n法庭：好的。好的。那么，我认为这就完成了本案今天的听证，我们相信很快会再见到各位。\n\nMR. DESPINS：谢谢您，法官阁下。\n\n法庭：好的。谢谢各位。\n\n全体律师：谢谢您，法官阁下。\n\n法庭：保重。现在休庭。\n\n（程序于 1:31 p.m. 结束。）\n\nHo Wan Kwok（郭文贵）- May 10, 2023　20\n\n2　本人，CHRISTINE FIORE（克里斯汀·菲奥雷），经法院批准的速录誊写员及认证电子记录员和誊写员，证明上述内容系根据上述案件程序的正式电子录音制作的准确庭审记录。\n\n9　May 17, 2023\n\n10　Christine Fiore（克里斯汀·菲奥雷），CERT","key_entities":["Kwok","Ho Wan Kwok","Despins","Je","Paul Hastings","Guo","CIPA","Luc Despins"],"ecf_references":[],"word_count":4847,"status":"published","published_at":"2023-05-17 00:00:00","created_at":"2023-05-17","updated_at":"2026-08-23 18:35:29"}
