TO SCHEDULE A STATUS CONFERENCE, SET BRIEFING SCHEDULE AND SCHEDULE HEARING REGARDING ITS MOTION TO DISMISS CHAPTER 11 CASE OR, IN THE ALTERNATIVE, PARTIAL JOINDER TO UNITED STATES TRUSTEE'S MOTION FOR AN ORDER DIRECTING THE APPOINTMENT OF A CHAPTER 11 TRUSTEE**\n\nNow comes Pacific Alliance Asia Opportunity Fund L.P. (\"PAX\"), and through the\n\ninstant motion (the \"Motion\"), hereby moves the Court for entry of an order pursuant to sections\n\n105(a) and (d)(1) of Title 11 of the United States Code (the \"Bankruptcy Code\") and Rules 2002,\n\n9006, and 9007 of the Federal Rules of Bankruptcy Procedure (the \"Bankruptcy Rules\")\n\nscheduling a status conference, setting a briefing schedule and hearing date and limiting notice of\n\nthe hearing on its *Motion to Dismiss Chapter 11 Case or, in the Alternative, Partial Joinder to*\n\n<sup>1</sup> The last four digits of the Debtor's taxpayer identification number are 9595.\n\n*United States Trustee's Motion for an Order Directing the Appointment of a Chapter 11 Trustee*  (the \"Dismissal Motion\") as set forth in the Proposed Order (the \"Order\") attached hereto as Exhibit A. In further support of its Motion, PAX states as follows:\n\n### **JURISDICTION**\n\n1. The Court has jurisdiction to consider this matter pursuant to 28 U.S.C. §§ 157 and 1334. This is a core proceeding pursuant to 28 U.S.C. § 157(b)(2).\n\n2. For purposes of this Motion, PAX accepts that venue may be proper in this district without prejudice to any future motion to transfer venue. This Motion is a core proceeding under 28 U.S.C. §157(b).\n\n3. The predicate for the relief requested herein is sections 105(a) and (d)(1) of the Bankruptcy Code; Bankruptcy Rules 2002, 9006, and 9007; and Rules 2002-1 of the Local Rules of the United States Bankruptcy Court for the District of Connecticut.\n\n### **BACKGROUND**\n\n4. As described in the Dismissal Motion, (i) Kwok is abusing the bankruptcy system; (ii) Kwok is acting in bad faith by improperly attempting to make PAX relitigate already-resolved legal issues in a new forum; (iii) Kwok's estate is diminishing and has no reasonable prospect of rehabilitation, an enumerated cause for dismissal under the Bankruptcy Code; and (iv) Kwok's behavior constitutes \"gross mismanagement of the estate,\" as set forth in section 1112(b)(4)(B) of the Bankruptcy Code.\n\n5. To address the numerous concerns raised by the Debtor's behavior and his inability to rehabilitate through this chapter 11 case, the Dismissal Motion provides uncontroverted facts through multiple state court records, decisions, and proceedings that substantiate dismissal. Further, the Dismissal Motion also analyzes the relevant multi-factor tests for dismissal and the voluminous facts supporting the analysis. The Dismissal Motion also seeks the appointment of a chapter 11 trustee as alternative relief.\n\n### **REQUESTED RELIEF AND AUTHORITY**\n\n6. PAX respectfully requests entry of the Order (1) setting a status conference on the Dismissal Motion for **April 13, 2022 at 10:00 a.m.**, the same date and time the Court is currently scheduled to preside over several other matters in this chapter 11 case, including the United States Trustee's *Motion for Order Directing Appointment of an Examiner, or in the Alternative, Motion for Order Directing the Appointment of a Chapter 11 Trustee* (the \"Trustee Motion\") [Dkt No. 102].\n\n7. By this Motion, PAX also requests an entry of an Order setting a briefing schedule and setting a hearing date on the Dismissal Motion and limiting notice to certain core constituents and other parties who have registered to receive notice through the ECF system. Cause exists for the granting of this relief.\n\n8. In pertinent part, section 105(d)(1) of the Bankruptcy Code provides that the Court, \"on its own motion or on the request of a party in interest—(1) shall hold such status conferences as are necessary to further the expeditious and economical resolution of the case; and (2) unless inconsistent with another provision of this title or with applicable Federal Rules of Bankruptcy Procedure, may issue an order at any such conference prescribing such limitations and conditions as the court deems appropriate to ensure that the case is handled expeditiously and economically.\" 11 U.S.C. § 105(d)(1).\n\n9. Additionally, Bankruptcy Rule 9006(c) provides that \"when an act is required or allowed to be done at or within a specified time by these Rules or by a notice given thereunder or\n\n3\n\nby order of the court, the court for cause shown may in its discretion, with or without motion or notice, order the period reduced.\"\n\n10. Setting a status conference on the Dismissal Motion for April 13, 2022 at 10:00 a.m. will promote judicial economy and reduce administrative expense as the Debtor, PAX, the Office of the United States Trustee and counsel for the Official Committee of Unsecured Creditors, as well as other parties in interest will be in Court for other matters currently on the Court's calendar.\n\n11. Further, cause exists to set a briefing schedule and schedule a hearing on the Dismissal Motion as soon practicable at the convenience of the Court. PAX has provided evidence through the Dismissal Motion of (i) Kwok's abuse of the bankruptcy system; (ii) Kwok's bad faith; (iii) the fact that there is no reasonable prospect of Kwok's rehabilitation through this chapter 11 case; and (iv) the continued diminishment and Kwok's gross mismanagement of the bankruptcy estate (enumerated causes for dismissal under the Bankruptcy Code). A briefing schedule and hearing date will expeditiously join the issues raised in the Dismissal Motion and permit the swift adjudication of the relief requested therein.\n\n12. Bankruptcy Rules 9007 and 2002(m) give the Court the power to regulate and designate the content, form, and recipients of notices. PAX seeks to limit the notice recipients of the Stay Motion to the following parties (hereinafter, the \"Notice Parties\"):\n\n- a. The Debtor;\n- b. The Office of the United States Trustee;\n- c. The Internal Revenue Service;\n- d. Counsel for the Official Committee of Unsecured Creditors; and\n\ne. Any other parties that have requested service pursuant to Bankruptcy Rule 2002 as of the time of service.\n\nPAX respectfully submits that such notice is sufficient and that no further notice of this Motion is required.\n\n13. PAX 谨请求法院下达该命令：(1) 将驳回动议的案情通报会定于 2022年4月13日 上午 10:00 举行，届时本法院原定在同一时间主持审理本第 11 章案件中的其他若干事项，包括美国受托人的《要求下达指定审查人命令之动议，或备选之要求下达指定第 11 章受托人命令之动议》（“受托人动议”）[Dkt No. 102]。\n\n7. 通过本动议，PAX 还请求下达一项命令，设定驳回动议的书面陈词时间表并确定听证日期，同时将通知限制发送给某些核心当事人以及已注册通过 ECF 系统接收通知的其他当事人。准予该项救济具有充分理由。\n\n8. 《破产法典》第 105(d)(1) 条相关部分规定，法院“可依自身职权或应利害关系方的请求——(1) 召开为促进案件迅速且经济解决所必需的案情通报会；以及 (2) 除非与本编的另一项规定或适用的《联邦破产诉讼规则》相抵触，可在任何此类会议上下达命令，规定法院认为适当的限制和条件，以确保案件得到迅速且经济的处理。”11 U.S.C. § 105(d)(1)。\n\n9. 此外，《破产规则》第 9006(c) 条规定，“当某项行为根据本规则、或根据本规则发出的通知、或根据法院命令被要求或允许在指定时间内完成时，法院在说明理由的情况下，可酌情经由或不经由动议或通知，命令缩短该期限。”\n\n10. 将驳回动议的案情通报会定于 2022年4月13日 上午 10:00 将有助于提升司法效益并减少行政支出，因为债务人、PAX、美国受托人办公室、Official Committee of Unsecured Creditors（无担保债权人官方委员会）的律师以及其他利害关系方届时都将因目前已列入法院日程的其他事项而出庭。\n\n11. 此外，在法院方便的情况下尽早为驳回动议设定书面陈词时间表并安排听证具有充分理由。PAX 已通过驳回动议提供了关于以下事实的证据：(i) 郭文贵对破产制度的滥用；(ii) 郭文贵的恶意；(iii) 郭文贵通过本第 11 章案件没有合理的复兴前景这一事实；以及 (iv) 破产财产的持续缩减以及郭文贵对破产财产的重大管理不善（《破产法典》下明确列举的驳回诉由）。书面陈词时间表和听证日期将迅速汇总驳回动议中提出的各项争议焦点，并使其中所请求的救济得到迅速裁决。\n\n12. 《破产规则》第 9007 和 2002(m) 条赋予法院规范和指定通知的内容、形式及接收方的权力。PAX 寻求将中止动议的通知接收方限制为以下各方（以下简称“受通知方”）：\n\n- a. 债务人；\n- b. 美国受托人办公室；\n- c. Internal Revenue Service（美国国家税务局）；\n- d. 无担保债权人官方委员会的律师；以及\n\ne. 截至送达之时，已依据《破产规则》第 2002 条要求送达的任何其他当事人。\n\nPAX 谨此提请认为此类通知已经足够，且无需就本动议发出进一步通知。\n\n13.
