L. No 116–182, 134 Stat. 894 (Oct. 21, 2020), to confirm the Government's disclosure obligations under *Brady* v. *Maryland*, 373 U.S. 83 (1963), and its progeny, and to summarize the possible consequences of violating those obligations.\n\nThe Government must disclose to the defense all information \"favorable to an accused\" that is \"material either to guilt or to punishment\" and that is known to the Government. *Id.* at 87. This obligation applies regardless of whether the defendant requests this information or whether the information would itself constitute admissible evidence. The Government shall disclose such information to the defense promptly after its existence becomes known to the Government so that the defense may make effective use of the information in the preparation of its case.\n\nAs part of these obligations, the Government must disclose any information that can be used to impeach the trial testimony of a Government witness within the meaning of *Giglio v. United States*, 405 U.S. 150 (1972), and its progeny. Such information must be disclosed sufficiently in advance of trial in order for the defendant to make effective use of it at trial or at such other time as the Court may order.1\n\n<sup>1</sup> This Order does not purport to set forth an exhaustive list of the Government's disclosure obligations.\n\nThe foregoing obligations are continuing ones and apply to materials that become known to the Government in the future. These obligations also apply to information that is otherwise subject to disclosure regardless of whether the Government credits it.\n\nIn the event the Government believes that a disclosure under this Order would compromise witness safety, victim rights, national security, a sensitive law-enforcement technique, or any other substantial government interest, it may apply to the Court for a modification of its obligations, which may include in camera review or withholding or subjecting to a protective order all or part of the information otherwise subject to disclosure.2\n\nFor purposes of this Order, the Government has an affirmative obligation to seek all information subject to disclosure under this Order from all current or former federal, state, and local prosecutors, law enforcement officers, and other officers who have participated in the prosecution, or investigation that led to the prosecution, of the offense or offenses with which the defendant is charged.\n\nIf the Government fails to comply with this Order, the Court, in addition to ordering production of the information, may:\n\n- (1) specify the terms and conditions of such production;\n- (2) grant a continuance;\n- (3) impose evidentiary sanctions;\n- (4) impose contempt or other sanctions on any lawyer responsible for violations of the Government's disclosure obligations, or refer the matter to disciplinary authorities;\n\n<sup>2</sup> The Classified Information Procedures Act sets forth separate procedures to be followed in the event that the Government believes matters relating to classified information may arise in connection with the prosecution. *See* 18 U.S.C. app. 3 § 1 *et seq*.\n\n- (5) dismiss charges before trial or vacate a conviction after trial or a guilty plea; or\n- (6) enter any other order that is just under the circumstances.\n\nSO ORDERED.\n\nDated: April 5, 2023 New York, New York\n\nAS","body_zh":"UNITED STATES DISTRICT COURT SOUTHERN DISTRICT OF NEW YORK（美国纽约南区联邦地区法院）\nUNITED STATES OF AMERICA（美利坚合众国）\n\n诉\n\nYANPING WANG（王雁平）\n\nUSDC SDNY（美国纽约南区联邦地区法院）电子归档文件 文件编号：__________________ 归档日期：4/5/2023\n\n23 Cr. 118-3 (AT)\n\n裁定\n\n被告。\n\n地区法官 ANALISA TORRES（阿娜丽莎·托雷斯）：\n\n本裁定系根据《联邦刑事诉讼规则》第 5(f) 条以及《正当程序保护法》（Pub. L. No 116–182, 134 Stat. 894 (Oct. 21, 2020)）作出，旨在确认政府在 Brady v. Maryland（布雷迪诉马里兰州案）, 373 U.S. 83 (1963) 及其衍生判例项下的披露义务，并概述违反这些义务可能导致的后果。\n\n政府必须向辩方披露政府所知晓的所有“对被告人有利”且“对定罪或量刑具有实质性影响”的信息。同前引案，第 87 页。无论被告是否请求提供该等信息，亦无论该等信息本身是否构成可采纳的证据，此项义务均适用。政府应在知悉该等信息存在后及时向辩方披露，以便辩方在案件准备过程中有效利用该信息。\n\n作为上述义务的一部分，政府必须披露符合 Giglio v. United States（吉格利奥诉美国案）, 405 U.S. 150 (1972) 及其衍生判例含义的、可用于质疑政府证人庭审证言可信度的任何信息。该等信息必须在开庭前充分提前披露，以便被告在庭审中有效利用，或在法院可能命令的其他时间披露。1\n\n1 本裁定无意列出政府披露义务的穷尽性清单。\n\n前述义务为持续性义务，适用于政府在未来知悉的材料。对于原本属于应当披露范围的信息，无论政府是否确信其真实性，这些义务均同样适用。\n\n如果政府认为根据本裁定进行的披露会危害证人安全、受害人权利、国家安全、敏感的执法手段或任何其他重大的政府利益，政府可向法院申请变更其义务，包括进行秘密审阅（in camera review），或者对原本应当披露的全部或部分信息予以扣留或受制于保护令。2\n\n就本裁定而言，政府负有主动义务，向所有曾参与起诉或参与导致起诉被告所受指控罪名之调查的现任或前任联邦、州及地方检察官、执法人员及其他官员，索取根据本裁定应当披露的所有信息。\n\n如果政府未能遵守本裁定，法院除命令提供该信息外，还可以：\n\n(1) 明确该等提供的条款和条件；\n(2) 准予延期审理；\n(3) 施加证据层面的制裁；\n(4) 对违反政府披露义务负有责任的任何律师处以藐视法庭或其他制裁，或将有关事项移交给纪律处分机构；\n\n2 如果政府认为在起诉过程中可能出现涉及机密信息的事项，则应遵循《机密信息程序法》（Classified Information Procedures Act）规定的单独程序。参见 18 U.S.C. app. 3 § 1 et seq.。\n\n(5) 在开庭前驳回指控，或在庭审或认罪答辩后撤销定罪；或\n(6) 作出在当时情形下公允的任何其他裁定。\n\n特此裁定。\n\n日期：2023年4月5日 纽约州纽约市\n\nAS","key_entities":["Je","Classified Information","Yanping Wang","Torres","Analisa Torres","Brady","Giglio","CIPA"],"ecf_references":[],"word_count":581,"status":"published","published_at":"2023-04-05 00:00:00","created_at":"2023-04-05","updated_at":"2026-08-23 07:22:14"}
