同时还主张：\n真正导致这些客户经济损失的是政府，而不是被告，\n那么“financial victims”这个标签本身也不是没有意义的。\n检方完全可以据此主张：\n这些投资人的代理律师自己进入刑事案件，援引了《犯罪受害人权利法》，并且把自己的客户称为“financial victims”。\n这当然不能自动证明他们到底是谁的受害人，也不能自动证明是哪个被告、哪项犯罪行为造成了损失。478 的完整内容仍然很重要，尤其如果盖尔明确否认是被告造成了这些客户的损失。\n但是，这种表述确实制造了一个真实的诉讼风险，而如果盖尔始终只坚持：\n“第三方财产所有人 + Rule 41(g)”\n这种理论，这个风险原本是可以不存在的。\n所以，\n对被告最有利的状态：\n盖尔依据 Rule 41(g)
