中的权利和抗辩；也不得拿这个和解令去证明任何claim或defense的构成要件。 \n\n新增的第7段更宽。它规定，批准5739以及Settlement Agreement，包括特别提到的 Section S，均不得构成任何非 Trustee / United States 实体对 Trustee 或 bankruptcy estate 所拥有的 rights、interests、claims、causes of action、defenses 的放弃、消灭或者损害。\n\n而新增第8段是目前最值得26-1853注意的地方。它不是泛泛写“保留郭的权利”，而是直接点名 SDNY 23-cr-118：\n\n批准5739不得损害 Ho Wan Kwok proceeding中的产权证明。这很接近“批准和解≠裁决第三方产权”。 但它并没有直接写成“所有§853(n)/§1963(l) petition automatically preserved and successful”，刑事附属没收程序里的具体产权仍然要按相应程序证明。\n\n还有一个非常值得注意的细节：5777拟议令第1段仍然写着，未撤回、未和解的 objections 和 reservations of rights 都被 overruled；但紧接着第4、7、8段又专门把重要权利 carve out。 所以如果法院最后签的就是这一版，实际结果更像：\n\n“你们没有成功阻止5739整体批准，但批准5739不能被用来消灭你们另行存在的产权/诉权，也不能封死郭在刑案中关于forfeiture
