Despins, in\nhis capacity as Chapter 11 trustee (the \n'Trustee') for the estate of Mr. Ho Wan Kwok,\nfiled the Motion to Compel Compliance with\nPreliminary Injunction and Quash Individual\nDebtor's Claims Objections (the 'Motion').\n(Main Case ECF No. 1345.) That same day,\nthe Trustee filed a motion analogous to the\nMotion (the 'Adversary Motion,' and, together\nwith the Motion, collectively, the 'Motions')\ninsofar as it sought to compel compliance with\nthe preliminary injunction in the adversary\nproceeding Pac. All. Asia Opportunity Fund\nL.P. v. Kwok (In re Kwok), Case No. 22-\n50073 (JAM), Adv. P. No. 22-05032 (JAM)\n(Bankr. D. Conn. Jan. 13, 2023) (hereinafter,\nthe 'Adversary Proceeding') in the Adversary\nProceeding. (Adv. ECF No. 142.) Objections\nand replies were filed. A hearing on the\nMotions was held on January 26, 2023. On\nJanuary 27, 2023, the Court granted the relief\nsought by the Motion as it related to the Mr.\nKwok’s objections to claims. (Main Case ECF\nNo. 1399.) Subsequently, the Trustee\nindicated that this action had achieved the\nresult he sought through the Motions. Hence, \nwhile the Motions are before the Court as\nthey relate to compelling compliance with the\npreliminary injunction, the Court has not acted\non the Motions. During a hearing on\nSeptember 19, 2023, the Court inquired as to\nthe status of the Motions and the Trustee told\nthe Court he would report back. Accordingly,\nit is hereby\nORDERED: The Court will not act on the\nMotions (Main Case ECF No. 1345; Adv. ECF\nNo. 142) at this time. The parties may request\nthe Court take up the Motions again.
