1. On April6, 2022, Pacific Alliance Asia Opportunity Fund L.P. ("PAX" ), a

creditor and party-in-interestin th ese proceedings filed its Motion to Dism iss Ch apter 11 Case

or, in th e Alternative, PartialJoinder to United States Trustee' s Motion for an Order Directing

Appointm entofa Ch apter 11 Trustee (th e "Motion to Dism iss" )[ECF183].

2. Subsequentth ereto, th e Courtseta briefing sch edule w ith respectrequiring any opposition to be filed on or before May 11, 2022 and PAX' s reply briefto be filed by May 18,

4. Also on May 11, 2022, m om ents before th e Creditors w ere filing th eir Objection to th e Motion to Dism iss, th e debtor H o W an Kw ok (th e "Debtor" )filed h is Consent to Dism issalofCase and response to th e Motion to Dism iss [ECF344].

5. On May 18, 2022, PAX filed its Reply. [ECF39 2].

6. Ata Status Conference before th e Courton M ay 17, 2022, th e Courtgranted th e parties th e opportunity to file supplem entalposition papers to address th e alternatives of dism issal, conversion or appointm entofa Ch apter 11 trustee no later th an 5:00 p.m . on May 20, 2022. [ECF381]. Th e page lim itation for th e supplem entalbriefing w as setatseven pages.

7. Th e Creditors h ave tried to be as succinctas possible in th e supplem ental briefing, but given th e im portance and detailed nature ofth e issues involved and th e radical ch ange ofth e Debtor' s position w ith respectto th e Motion to Dism iss, th e Creditors seek perm ission from th e Courtto exceed th e page lim its for th eir Supplem entalStatem ent.
