> In a criminal court proceeding involving asset forfeiture and restitution, the 853(n) claimant typically gets "paid" (or recovers their property) first, before the funds are distributed to CVRA (Crime Victims’ Rights Act) victims through restitution.
> The reason for this lies in the legal distinction between ownership and compensation.
> 1. 853(n) Claimants: The "Owners"
> Under federal law (21 U.S.C. § 853(n)), an ancillary proceeding is held to determine if a third party (the claimant) has a superior legal interest in the property being forfeited.  
> • Status: An 853(n) claimant is arguing that the property already belongs to them, not the defendant.  
> • Priority: Because the court cannot legally forfeit property that the defendant didn't actually own, the 853(n) claim must be resolved before the government takes final title to the assets. If the claimant wins, the property is returned to them immediately and never enters the pool of money available for the government to give to others.
> 2. CVRA Victims: The "Compensated"
> The Crime Victims’ Rights Act (CVRA) and the Mandatory Victims Restitution Act (MVRA) give victims the right to "full and timely restitution."  
> • Status: Victims are generally "creditors" of the defendant. They are owed money because of the harm caused, but they do not necessarily have a pre-existing ownership claim to the specific assets seized by the FBI or DEA.
> • Priority: Restitution is usually paid out of the assets the government successfully forfeits (the "net" proceeds). Therefore, the victims only get paid after the 853(n) claimants have taken their share and the government has finalized the forfeiture.
