The Government has continued to rely on disputed creditor claims that multiple third parties have identified as fictitious, while declining to clarify, disclose, or test those claims through any adversarial proceeding. This posture raises serious due process concerns under Brady and its progeny, and independently requires a §853(n) hearing to determine ownership and the legitimacy of asserted claims before forfeiture or dissipation continues.
