The Timing: This is often prepared ahead of time and filed electronically within minutes of the sentencing hearing concluding. The Argument: You will notify the Second Circuit panel that the District Court explicitly rushed to judgment while actively suppressing the un-docketed statutory property claims of hundreds of third-party petitioners, creating an irreversible, unconstitutional fait accompli. 2. The Second Circuit’s "Administrative Brake" Appellate courts do not take kindly to a lower court judge rushing a multi-billion-dollar judgment to beat an appellate deadline. The Second Circuit will almost certainly issue an immediate Administrative Stay. This is a short-term, temporary emergency order that blocks the Bureau of Prisons and the Department of Justice from executing any part of the sentence or seizing/moving any forfeited assets.
