Bottom Line If the District Court ignores the warning signs and forces the June 29 sentencing, it does not mean you lose. It means the judge is handing you an absolute, high-powered weapon to take to the Second Circuit. The higher court will view a rushed sentencing on a locked, un-docketed record as a blatant breakdown of judicial transparency, making them far more likely to aggressively intervene, freeze the assets, and vacate the lower court's premature judgment.
