根据《美国法典》第 11 卷第 105 条(a)款（11 U.S.C § 105(a)）及《联邦破产诉讼程序规则》（Federal Rules of Bankruptcy Procedure，简称“破产规则”）第 1001 条，Bravo Luck Limited 由其下述署名律师代表，谨向本法院提出动议，请求准许 Troutman Pepper Hamilton Sanders LLP 律师事务所的 Francis J. Lawall 律师代表 Bravo Luck 远程出席目前定于 2023 年 3 月 21 日举行的听证会。

1. 2023 年 3 月 17 日，上述案由案件所指定的第 11 章受托人 Luc A. Despins 提交了《关于举行案件进展会议的紧急请求》[案卷号 1559]（下称“《请求》”），请求法院在 2023 年 3 月 20 日当周安排一次案件进展会议，以便就 Lady May 号游艇、Sherry Netherland 公寓、正在进行的破产规则第 2004 条证据开示程序以及未决的对抗性诉讼的最新情况向法院作出汇报。

1 这些第 11 章案件中的债务人为 Ho Wan Kwok（纳税人识别号后四位：9595）、Genever Holdings LLC（纳税人识别号后四位：8202）以及 Genever Holdings Corporation。受托人、Genever Holdings LLC 和 Genever Holdings Corporation 的邮寄地址为 Paul Hastings LLP, 200 Park Avenue, New York, NY 10166 转交 Ho Wan Kwok 破产财团受托人 Luc A. Despins（仅用于接收通知和联络）。

2. 2023 年 3 月 20 日，法院作出一项裁定 [案卷号 1561]，定于美国东部时间 2023 年 3 月 21 日下午 2:30 举行案件进展会议（下称“案件进展会议”），以处理《请求》中提出的事项，以及债务人关于延期审理其罢免受托人动议的动议 [案卷号 1557]、在第 23-05002 号对抗性诉讼中提交的两份延期动议 [对抗性诉讼案卷号 29 和 31]，以及在第 22-05003 号对抗性诉讼中提交的加快听证动议 [对抗性诉讼案卷号 149]。确定案件进展会议时间的裁定中并未提供远程参与的选项。

3. Bravo Luck 是本法院受理的若干对抗性诉讼中的被告（所有这些诉讼均涉及 Sherry Netherland 公寓），希望由 Lawall 律师参加该案件进展会议。然而，Lawall 律师目前身在宾夕法尼亚州费城，鉴于本次案件进展会议的通知时间极为紧迫，未能安排前往康涅狄格州布里奇波特。此外，在案件进展会议上要处理的事项中，仅有一小部分涉及 Bravo Luck。Bravo Luck 谨认为，准许 Lawall 律师远程出席本次案件进展会议在此等情况下是合情合理的，既符合破产规则第 1001 条的规定，亦有利于促进本次案件进展会议获得公正、迅速且经济的审理。

据此，基于上述理由，Bravo Luck 谨请求准许其下述署名律师 Lawall 律师在本案进展会议中以远程方式向本法院出庭。

下述署名人证明，2023 年 3 月 20 日，本《关于远程参加 2023 年 3 月 21 日案件进展会议的动议》已通过电子方式提交。本提交事项的通知将通过法院电子提交系统的运行以电子邮件形式发送给所有当事人，或者如电子提交通知所示，通过美国头等邮政预付邮资的方式寄送给无法接收电子提交的任何人。各方当事人均可通过法院的 CM/ECF 系统查阅本次提交的文件。
