一、地院（SDNY） vs 二巡（2nd Cir）送达差异 Mandamus 属于 Appellate Action → 所以二巡要求： ✔ filing fee / or IFP ✔ certificate of service ✔ 服务对象： (a) District Court Judge（即 Torres） (b) Opposing counsel（即 SDNY AUSA） 这在你收到的退件 notice 里已经明确写了： “Also… you must note that you served … District Court Judge … and opposing counsel.” 这个要求不是“可选项” 是 Rule 21 Code → 强制要求
