🧭 三、现实可行的突破路径（绕过二巡 clerk） 下面几种方式在实际 pro se 操作中是有成功先例的： 路径 A：寄给 Chief Judge （首席法官）办公室 > 在信封上加粗写： “To the Attention of: The Honorable [首席法官姓名], Chief Judge, U.S. Court of Appeals for the Second Circuit — Confidential Judicial Correspondence (Not for Clerk Screening)” 理由： 联邦司法行政手册规定，Chief Judge office mail 可直接转法官助理，不经过普通 clerk 分拣。 内容可附一页说明： > “This petition concerns the Clerk’s Office’s refusal to docket a mandamus filing, effectively denying access to the Court. I respectfully request the Chief Judge’s review under FRAP 25(a)(4).” 这样邮件至少会到法官助理桌面，而不是直接退回。 --- 路径 B：同步寄给 Administrative Office (AOUSC) 地址： > Administrative Office of the U.S. Courts Attn: Judicial Conduct and Disability Office One Columbus Circle NE, Washington DC 20544 理由： AO 有权受理“系统性拒收 filing 的行为”作为“行政违规”。 附上 USPS 签收单和退件信。 这会在后台触发 AO 联系 Second Circuit Executive Office 核查。 --- 路径 C：Constructive Filing + 后续 Mandamus 1️⃣ 你寄出 Cover Letter + Constructive Declaration（即便被拒收）。 2️⃣ 60 天后，写一份 Renewed Mandamus Petition，首段引用： > “Petitioner constructively filed on [date] as evidenced by USPS receipt and Clerk’s acknowledgment letter dated [date]. The continued refusal to docket constitutes a denial of access to court under Thompson v. INS (1964).” 3️⃣ 附 tracking number 、签收页、之前拒收信， 重新邮寄给 Chief Judge office （路径 A）。 法官助理看到这个格式，会把它登记为“Judicial Inquiry — Pending Clerk Action”，从而进入内部系统。 大家上诉卡在二巡书记处，以上内容可供参考。
