ORDER REGARDING MOTION TO COMPEL COMPLIANCE: On January 19, 2023, Mr. Luc A. Despins, in his capacity as Chapter 11 trustee (the 'Trustee') for the estate of Mr. Ho Wan Kwok, filed the Motion to Compel Compliance with Preliminary Injunction and Quash Individual Debtor's Claims Objections (the 'Motion'). (Main Case ECF No. 1345.) That same day, the Trustee filed a motion analogous to the Motion (the 'Adversary Motion,' and, together with the Motion, collectively, the 'Motions') insofar as it sought to compel compliance with the preliminary injunction in the adversary proceeding Pac. All. Asia Opportunity Fund L.P. v. Kwok (In re Kwok), Case No. 22- 50073 (JAM), Adv. P. No. 22-05032 (JAM) (Bankr. D. Conn. Jan. 13, 2023) (hereinafter, the 'Adversary Proceeding') in the Adversary Proceeding. (Adv. ECF No. 142.) Objections and replies were filed. A hearing on the Motions was held on January 26, 2023. On January 27, 2023, the Court granted the relief sought by the Motion as it related to the Mr. Kwok’s objections to claims. (Main Case ECF No. 1399.) Subsequently, the Trustee indicated that this action had achieved the result he sought through the Motions. Hence, while the Motions are before the Court as they relate to compelling compliance with the preliminary injunction, the Court has not acted on the Motions. During a hearing on September 19, 2023, the Court inquired as to the status of the Motions and the Trustee told the Court he would report back. Accordingly, it is hereby ORDERED: The Court will not act on the Motions (Main Case ECF No. 1345; Adv. ECF No. 142) at this time. The parties may request the Court take up the Motions again.
