I am an innocent investor in the G-series entities associated with the defendant, Ho Wan Kwok (a/k/a Miles Guo) My investment. detailed in the attached Exhibit A, was made with lawfully obtained funds into lawful entities. At the time of my investment, I had no knowledge of any alleged criminal activity. 2. I assert that my investment is not subject to forfeiture by the government or transfer to the bankruptcy estate in Case No. 22-50073. The Chapter 11 Trustee, Luc A. As of today, the trustee has depleted approximately $60 million, about 30% of the trust's value-primarily in attorney fees. as described Page 5 of 5 of Case 1 :23-cr-0118~AT Document 754. Furthermore, Luc A. Despins has retied on unverified and inflated claims to assert others' interests in the frozen assets, directly harming my property interest. IL Non-victim Status Under the Crime Victims' Rights Act 1. I am not a victim under the Crime victims' Rights Act (CVRA), 18 U.S.C. s 3771, in. connection with the alleged offenses in this case. E was not defrauded by Mr. Kwok. and any characterization of me as a "victim" by the government or other parties is factually Incorrect. 2. The government's identification of "thousands of victims" remains unclear.
